Except for claims for damages due to the absence of warranted characteristics or those arising under the Product Liability Act, all claims for damages (e.g., due to pre-contractual liability, breach of contract, or tort) against us are excluded unless they are based, in dealings with merchants, on intent or gross negligence on the part of our legal representatives or senior executives, or otherwise on intent or gross negligence by our vicarious agents or assistants. In cases of delay or impossibility, we are liable towards non-merchants also for negligence, but only to the extent of the additional costs for a substitute purchase or substitute performance. For the breach of essential contractual obligations ("cardinal obligations"), we are also liable for simple negligence on the part of our legal representatives and senior executives, but limited to typical and foreseeable damages. Where Ibex Global GmbH is jointly liable with others as a joint debtor, it shall always be liable on a subsidiary basis as the last resort.

Ibex Global GmbH is only liable for data loss if such data has been backed up in machine-readable form at appropriate intervals, at least once per day. The above limitations of liability also apply in favor of our legal representatives, senior executives, and vicarious agents.
